Overview

Unisinos Graduate Program in Law is noted for conducting high-level research, contributing to the progress of Law science and disseminating its intellectual production in the law community and society. This program stands out for carrying out research that translates the state of the art in Theory of Law and State, including studies on globalization and human rights as well as criticism of the legal doctrine and its many particularities. Within the context of interinstitutional relations, this graduate program keeps agreements with important teaching and research institutions in Europe and the Americas, providing teachers and students with the opportunity for information exchange and joint production.

Areas of Study

Hermeneutics, Constitution and Realization of Rights
As the emphasis of this program is Public Law, it is paramount to include in the scope of research discussions on State and the necessary responses to social demands, based on the realization of fundamental social rights. Thus, the research developed within this area of study aims to delve into the current criticism of traditional hermeneutical models, based on the contributions of Semiotics, Philosophical Hermeneutics, and theories of Legal Argumentation. From this follows the need to investigate the effectiveness of Law and applicability of rules by Courts, based on a review of currently prevailing concepts in the doctrine, jurisprudence, Theory of the State and Theory of Law, where the study of the Constitution and Jurisdiction is essential, as well as their relationships with other areas of Material and Procedural Law. This area of study fosters a reflexive critical debate from the perspective of centrality of the Constitution and Constitutionalism within an increasingly complex and fragmented environment.

Society, New Rights and Transnationalization
The research developed within this area of study focuses on the changes in Law, enhanced by the transformations in contemporary institutional structures, emergence of new rights (third and forth dimensions) and inflow of the phenomenon of globalization. These changes impose on jurists the need to reflect on the forms of institutionalization of contemporary societies. This area of study also addresses emerging rights, such as bioethics, biolaw, protection of intellectual property, diffuse and collective rights, fundamental human rights, and rights and obligations generated by new technologies, from a transdisciplinary perspective related to the notion of complexity, prioritizing the discussion of Society grounded on contemporary theories.

Master's Degree

The master’s degree course consists of 30 (thirty) credits:
- 6 credits related to required two activities common to both Research Lines (OC);
- 6 credits related to required two activities per Research Line (OLP) of 3 credits each.
- 12 credits in four electives activities per Research Line (ELP) of 3 credits each.
- 6 credits corresponding to the thesis project defense, orientation, defense and approval in the thesis.
- Proficiency Exam in a foreign language.
- Teaching Internship (optional).

Doctoral Degree

The doctoral degree consists of 30 (thirty) credits:
- Qualification Seminars (16 credits);
- Project Defense/Project Qualification (4 credits);
- Seminar on Guided Research (6 credits);
- Dissertation Writing and Defense (4 credits);
- Proficiency Exam in two a foreign language;
- Teaching Internship (optional).
The doctorate consists of 30 credits, related to Required activities and elective activities: eight credits related to the required Seminars; eight credits related to Elective Seminars; four credits relatede to the preparation and qualification of the dissertation project; six credits related to activities related to the Managed Research Seminar; two proficiency; teaching stage; four credits pertinent to the elaboration and defense of the Dissertation.

Project Defense (04 credits)
Preparation and presentation of the dissertation project before the evaluation board composed by the advisor professor and at least two other PhD professors.

Seminar on Guided Research (06 credits)
In order to make up the credits that pertain to the Managed Research Seminar Mandatory Activity, the student will have the following options observing the credit limit of each item:
- Publication of articles in journals with Qualis B3 to A1 (up to 3 credits)
- Doctorate Sandwich (Doctoral Internship) (up to 3 credits)
- Book Publishing and Book Chapters (up to 3 credits)
- Program Event Assistant (up to 3 credits)
- Assistant in events outside the Program (up to 2 credits)
- Presentation of works in events (up to 2 credits)

Dissertation Writing and Defense (04 credits):
The doctoral dissertation should address an unpublished theme, linked to the theme of one of the Program's Research Lines and with scientific methodology. Its defense must prove the existence of the hypotheses raised, originality of the theme and contribution to the legal knowledge.
The Defense Board consists of five doctoral professors, one being the advisor professor, two professors from other institutions and two other professors from the Program.

Special students (non-degree study) Back to menu

Unisinos Graduate Programs admit non-regular students in some courses of the professional master’s degree. Non-regular students are students from other Unisinos Graduate Programs, other higher education institutions, and undergraduate or graduate students not affiliated with any Graduate Program. This opportunity allows non-regular students to know some of the courses offered by Unisinos.

Each semester the number of available places for these courses is announced and the programs offer enrollment for students who show evidence of ability to pursue them. Therefore, they need to be approved by the Coordination Committee and register as provided in the program regulations.
